NYPD Officer Hawreluk refuses to take report or call ACS

Description of Incident:
[dropcap]O[/dropcap]n December 31, 2011 my 4 year old daughter told me she was hit with a hammer in her foot about a week earlier. Judge Debra J. Kiedaisch ordered my wife to pay for my visit (my wife should never have had custody) on Christmas Eve. My wife did not comply. I got the visit on December 31, 2011 and I saw a 2-3 inch gash and another smaller cut on my daughter’s foot and took a photo/video. I reported it to Officer James Boyd on January 1, 2012. Boyd stated he had no jurisdiction because the kids were in the Bronx. This was odd because it wasn’t determined where the injury occurred. Boyd allowed me to write a report and told me not to write the name of the “defendant” because it was unclear who the suspect was. He had me write the report on a form I had never seen before (Supporting Deposition, CPL 100.20). He signed as the witness and not as the person taking the report. I stated in the report that this allegedly occurred while my children were in the care of my Jurema Laboy Padilla. I then went to the Bronx and called 911. Sixteen hours later, P.O. Hawreluk of the 47th Precinct arrived. He first stated that “there is no gash.” [pullquote-left] “there is no gash.” [/pullquote-left]He later stated, “Yeah, I saw it. I saw it with my own two eyes.” [pullquote-right] “Yeah, I saw it. I saw it with my own two eyes.” [/pullquote-right] He told me that someone in the house told him that my daughter was hurt by a toy. I tell him that my daughter gave me a different story and that I believed my daughter was being coached. He then states that he was not mandated to call ACS. He told me to report it to A.C.S. myself. I also told him that the court order from Orange County clearly stated that she was not to remove the children from the jurisdiction of that court, but they are living in the Bronx. I showed him the order. He did nothing. He did however threaten to arrest me for being present to report the incident in spite of the fact that the 47th Precinct instructed me to be present when the police arrived.
